Providing a glimpse of a philosophy style that is as rare as it is valuable, this book is an anthology with twelve essays concerning the thought of Philosophy Professor, Panayot Butchvarov, with his comments on each. His work reveals great depth, running the gamut of metaphysics, epistemology, ethics, philosophy of language, and philosophy of mind.

In his 1911 paper, “On the Relations of Universals and Particulars,” Bertrand Russell supposes the question whether universals are spatial or non spatial turns on the question of the existence of particulars. If particulars could be shown to exist, then since, according to Russell, they obviously are spatial, the non-spatiality of universals would be established. On the other hand, the denial of the existence of particulars would entail the spatiality of universals.In this paper, I argue that Russell’s claim is plausible (...) only if particulars are construed either as quality instances or as ordinary objects. If, however, particulars are either substrata or collections of qualities, nothing follows in regard to the spatiality or the non-spatiality of universals. Since the alternative interpretations of particularity are, I contend, at least as attractive as Russell’s, his failure to consider them makes his position less interesting than it might otherwise have been. Universal Human Rights brings new clarity to the important and highly contested concept of universal human rights. This collection of essays explores the foundations of universal human rights in four sections devoted to their nature, application, enforcement, and limits, concluding that shared rights help to constitute a universal human community, which supports local customs and separate state sovereignty. A solution to the problem of “overcriminalization” appears to be decriminalization of certain crimes. This Essay focuses on a group of crimes that has been labeled “proxy crimes” as a candidate to be eliminated. What are proxy crimes? Douglas Husak defines them as “offenses designed to achieve a purpose other than to prevent the conduct they explicitly proscribe.” Michael Moore describes them as involving situations where we “use one morally innocuous act as a proxy for another, morally wrongful act or (...) mental state.” Put that way, proxy crimes seem highly problematic, and Larry Alexander and Kimberly Ferzan bluntly put it, “We reject proxy crimes.” This Essay asks whether we should reject proxy crimes by presenting and evaluating Alexander and Ferzan’s treatment of the subject. After describing several different types of crimes that may be characterized as proxy crimes and Alexander and Ferzan’s rejection of most of them and their arguments for doing so, this Essay argues that their rejection of proxy crimes is incomplete, which leaves their theory open to a range of possibilities regarding the proper place of proxy crimes in criminal law. This Essay concludes that getting a handle on the problem of proxy crimes and overcriminalization requires a theory of the state and an articulation of the proper relationship between the state and its citizens that can give guidance on when the state can demand obedience from citizens to support the state and when failures to comply with such demands render one criminally culpable. Without such a theory, proposals to address overcriminalization cannot travel very far. (shrink)

ABSTRACTIn Inventing the Individual, Larry Siedentop traces the origins of Western liberal individualism to Christianity, which broke the hold of classical religiosity. In the classical view, according to Siedentop, there was no conceptual space for individuals, as society was seen as consisting of families, each worshipping its own god. Paul’s doctrine that everyone is equally a child of God enabled an individual-focused understanding of society to emerge. This began to happen with the rise of the Roman Empire and then (...) the Church, which placed all the equal individuals under a single sovereign. This paper explores the determiner corner of the ‘any’ land in Romanian, taking Lee and Horn 1994 and Horn 2000a as tour guides. The immediate interest of the task lies in the fact that the work done in English by the over-employed determiner any is carried out in Romanian by a host of more specialized (and, one fears, lower paid) morphemes, which I review in the rest of this section. My aim is to introduce the details of the Romanian facts (...) onto the scene and to show that an ‘indefinitist’ view that generalizes the scalar approach advocated in Horn’s work is useful in helping us understand the much more crowded Romanian field. The theory of any that serves as my starting point is summarized in Section 2. Section 3 proposes a generalization of the scalar view advocated by Horn in terms of an alternative-based approach in the spirit of Krifka 1995, Giannakidou 2001 and Kratzer and Shimoyama 2002, based on a novel way of defining alternatives. Section 4 looks at the consequences of the proposal, Section 5 considers ways of extending it, and Section 6 is a brief conclusion. The approach suggested here falls under what Horn calls quodlibetic theories. Its claim is that the unifying characteristic of both existentially and universally flavored free choice-like items is that they denote a maximal set of alternatives that verify the expression in which the item occurs. The scalar view is the important special case in which these alternatives form an implicational scale with respect to verifying the relevant expression. (shrink)

This article reconsiders Hannah Arendt’s account of “totalitarianism” in light of the climate catastrophe and the apparent inability of our political-economic system to respond to it adequately. In the last two chapters of The Origins of Totalitarianism, Arendt focuses on the “ideology” of totalitarian regimes: a pathological denial of reality, a privileging of the ideological system over empirical evidence, and a simultaneous feeling of total impotence and total omnipotence—an analysis that maps remarkably well onto the climate zeitgeist. Thus, while Arendt (...) used the concept of “totalitarianism” to foreclose alternatives to liberal capitalist democracy, the climate impasse suggests that the totalitarian label more properly belongs to the prevailing system itself. In this paper, I offer a novel view of the coherence (or structural) requirements on belief and intention, according to which they are not norms, but rather principles describing how your belief and intention operate. I first argue, on the basis of the unintelligibility of some relevant attitudes-reports, that there are conditions under which you simply do not count as believing or intending unless your beliefs and intentions satisfy the requirements: the conditions under which all of your relevant attitudes are (...) occurrent or activated. I then argue that you are subject to a coherence requirement only if your relevant attitudes are all activated, for you are not necessarily subject to the charge of irrationality in violating a coherence requirement when your attitudes are not all activated. If so, however, you satisfy the coherence requirements whenever you are subject to them, which makes it plausible that the “requirements” should be seen as descriptive principles about belief and intention. Many international business training programs present a viewpoint of cultural relativism that encourages business people to adapt to the host country's culture. This paper presents an argument that cultural relativism is not always appropriate for business ethics; rather, a code of conduct must be adapted which presents guidelines for core ethical business conduct across cultures. Both moral and economic evidence is provided to support the argument for a universal code of ethics. Critical realism provides an alternative to positivism and interpretivism. It foregrounds ontology and an evaluative approach to knowledge, while promoting eclectic reasoning, transdisciplinarity, and ethical research across the quantitative/qualitative, macro/micro and other divides. Health researchers have usefully employed critical realism, though it has also been dismissed as strange, a source of self-deception and hubris. Furthermore, it has been accused of dehumanizing many people. Responding to these charges, this article makes the case for carefully employing critical realism within and beyond social (...) studies of health. It first outlines some basic critical realist tenets before summarizing two exemplars within the sociology of health, illness and medical work. The discussion section, observing the principle of hermeticism, engages with some criticisms before offering a prolegomenon to research on the COVID-19 pandemic response. In conclusion, a ‘radical’ proposal is ventured for possible transformative action so that society is less hierarchical, more equal and salutogenic. (shrink)

The administered, normal cost and mark-up price doctrines are explained in parts I-III of the book, as many of their theoretical arguments are important for developing the foundations. This involves discussing the work of Gardiner Means, Philip Andrews, and Michal Kalecki as well as the developers of the doctrines, such as Edwin Nourse, Paolo Sylos Labini, Harry Edwards, Josef Steindl and Alfred Eisner. In this paper I will discuss three areas in which advances in human reproductive technology could occur, their uses and abuses, and their effects on society. First is the potential to drastically increase the success rate and availability of in vitro fertilization and embryo freezing. Second is the ability to perform biopsies on embryos prior to the onset of pregnancy. Finally, I will consider the adding or altering of genes in embryos, commonly referred to as genetic engineering.As new reproductive technologies (...) pass from experimental models into the potential for medical utilization, I believe that it will be important for lawmakers everywhere to avoid the impulse to outlaw procedures that a society believes to be unnatural at a first glance. Rather, I would hope that they can respond thoughtfully with legislation that serves two purposes — to protect the rights of couples to overcome infertility or to reduce the risk of genetic disease in their children-to-be, and more importantly, to protect children-to-be from the abuses that could result from some of the practices that I will discuss. The Covid‐19 pandemic has concentrated bioethics attention on the “lifeboat ethics” of rationing and fair allocation of scarce medical resources, such as testing, intensive care unit beds, and ventilators. This focus drives ethics resources away from persistent and systemic problems—in particular, the structural injustices that give rise to health disparities affecting disadvantaged communities of color. Bioethics, long allied with academic medicine and highly attentive to individual decision‐making, has largely neglected its responsibility to address these difficult “upstream” issues. This study investigates how collective corruption appears, using a computational method. Specifically, acknowledging that the characteristics of collective corruption process are analogous to percolation phenomena, we illuminate that collective corruption is formed by ongoing social interactions in an organizational boundary. By formulating a percolation-based system dynamics model, we consider the behavioral characteristics of collective corruption in terms of individuals’ corruption preferences governed by personal attributes on corruption. We also propose and examine scenarios regarding the formation of collective corruption.

This paper concerns broadly with the works of such ethical postmodern theorists as Jacques Derrida, Emmanuel Levinas, Giles Deleuze, focusing on how we can contribute to the development of their ideas by discussing Laozi and Zhuanzi’s Taoism, Buddhism, and modern Korean Neo-Confucianism of Toe-gae Lee. I claim that for criticism and art, literature, film and culture as well as philosophy itself, we are now facing this new need of another notion of subjectivity that not only accepts difference but takes the (...) position of whole positivity toward the Other. This different view of subjectivity that can be called "the sublime subjectivity" or the sublime totality of a human being or a society is essentially an aesthetic one, rather than one that depends upon logic, and it is vital to take advantage of Oriental ideas. From the perspective of the ethics of Levinas, I first place the sublime, jouissance, or pure enjoyment, at the heart of literary criticism. The pure sensibility of the sublime, or jouissance, unlike the raw feelings of pleasure, is an aesthetic sensibility beyond the ontological unity of feelings of pleasures and pains. Then with the Oriental thought, I make an attempt to contribute to the development of the ideas on the ethics of the relation of the reader and the literary text’s language. Laozi’s Taote Ching, Chuanzi, Diamond Sutra, and Toe-gae Lee’s notion of Taeguk are briefly explored in view of the aesthetic transphenomenal dimension and the sublime totality. (shrink)

McBride IIIira harkavy has given us much to consider. His paper, “Dewey, Implementation, and Creating a Democratic Civic University,” invites us to critically assess our democracy and the role of colleges and universities in the propagation of our democratic way of life. Harkavy suggests that universities are failing to fulfill their function, that (...) is, “to educate students to be ethical, empathetic, engaged, democratic citizens, and advance knowledge for the continuous betterment of the human condition” (50). He suggests that universities are central societal institutions in the world, and research universities are most central—“they develop new ideas and technologies, incubate businesses, serve as cultural and artistic centers, and are engines of local, national, and global economics” (50). Our universities produce our teachers and our teachers’ teachers; they shape the learning, values, and the aspirations of students (Harkavy 50). But, again, universities are not fulfilling their social function of “creating and sustaining an inclusive, just democratic society” (Harkavy 51). Harkavy boldly asserts that a revolutionary change is required in higher education if it is to fulfill its democratic function.Closed LoopI have a concern about the role of Research 1 (R1) universities in this picture. I am led to believe that R1 universities, like the University of Pennsylvania, exist in rarefied air. Penn, for example, has a ridiculous endowment—more than $20 billion. Penn apparently accepts only 9% of its applicants. The resources and demographics of R1 institutions are unlike those at state schools and small liberal arts colleges. The various canons, the faculty, and the student body at elite R1 universities have historically represented the thoughts, [End Page 76] experiences, and perplexities of well-heeled white heteronormative men. The vast majority of the faculty and students at R1 universities are predominantly of Anglo-European descent and a higher socioeconomic status. This gives me pause. If R1 universities are placed as the central engines of democratic fomenting, I worry that the faculty and students at R1 universities will direct research and social amelioration projects in particular directions and retain particular presuppositions that will buttress the continued flourishing of elite R1 universities. A closed loop. I worry that both the material and the social capital needed to (re)shape social conditions will arise only from and circulate only between those who attend elite R1 universities. I mean, Harkavy suggests that the departments, programs, and institutes at R1 universities create and sustain those knowledges and skills that produce the scholars and thoughtful people who will drive our K–12 education, who will fashion new cooperatives and entrepreneurial ventures, and who will become our community activists and political leaders. As such, the knowledge and skills to implement a more just and inclusive democracy will be disseminated from the R1 university. Harkavy also explains that it is necessary that universities strive to be democratic civic universities, sites where university folk work alongside members of the surrounding communities to address and ameliorate the problems on the ground. This “would involve significant and ongoing engagement of an institution’s comprehensive assets (academic, human, cultural, and economic) in partnership with community members to produce knowledge and educate ethical students with the ability to help create and maintain just, anti-racist, democratic societies” (Harkavy 53). The democratic civic university would then nurture a culture of democracy that exceeds mere voting practices— democracy as a way of life (Dewey 226). Prima facie, this seems like a noble goal. And yet, I still worry that those university folks who do this work will be a small representative group of people who bear particular life experiences and perhaps phenotypic markers.I would suggest that other sites outside of the R1 university (e.g., the trade union meeting, the settlement house, the church, the community garden, etc.) will need to be taken as legitimate sites of knowledge creation or legitimate sites of communication and joint activity (Collins 269). This would at least bring differing life experiences to the table; that is, it would bring differing life experiences to the fore and recognize alternative non-academic sources of insight and wisdom. I defend the position argued previously by Germain Grisez and me that total brain death is a valid criterion of death on the grounds that a human being is essentially a rational animal, and a brain-dead body lacks the radical capacity for rational actions. I reply to Josef Seifert’s objection that our positions rest on a reductionist view of the human person, and to other objections concerning the inter-relation between the human soul, its powers, and functions of the brain. In March 1996, the General Accounting Office issued the report Scientific Research: Continued Vigilance Critical to Protecting Human Subjects. It stated that “an inherent conflict of interest exists when physician-researchers include their patients in research protocols. If the physicians do not clearly distinguish between research and treatment in their attempt to inform subjects, the possible benefits of a study can be overemphasized and the risks minimized.” The report also acknowledged that “the line between research and treatment is not always clear (...) to clinicians. Controversy exists regarding whether certain medical procedures should be categorized as research.”This problem currently plagues gene transfer research. A few months prior to the GAO report, an ad hoc committee appointed by National Institutes of Health Director Harold Varmus expressed similar concerns in its assessment of NIH investment in research on gene therapy. Abstract Energy typically is discussed in terms of science, technology, economics, and politics. Little attention has been given to fundamental religious and ethical questions surrounding the upcoming transition to renewable energy. The essays in this thematic section seek to redress that deficiency. This introductory essay raises some key questions and summarizes various presentations on energy and religion, as these were held at the 2010 conference of the Institute on Religion in an Age of Science (IRAS). Some presentations described the energy (...) landscape and provided data and perspectives needed for sound policy. Others raised ethical and religious considerations for energy decisions as the transition from nonrenewable to renewable sources is faced. Some posed the challenges of the energy transition to religion itself. Yet others offered examples of sustainable energy use and/or promising sources for meeting future needs sustainably. At the conclusion of the conference, presenters crafted a common “Statement on Energy and Climate Change” that includes a “Call to Action.” The “Energy Statement” follows as an appendix. (shrink)
